Terms Of Use

By entering into a contractual agreement with EJ’s Appliance Repair, doing business as EJ’s Appliance Repair, you (the “Customer”) are subject to the following terms and conditions (“General Terms and Conditions of Service”) governing the services provided and the replacement part(s) or goods supplied. It is imperative to familiarize yourself with these terms before authorizing our technician to initiate any work. The commencement of service by our technician indicates your acceptance of all terms and conditions outlined herein.

NON-REFUNDABLE SERVICE CHARGE

We levy a non-refundable service fee (“Service Charge”) for all non-warranty visits to the Customer’s premises. This fee, covering travel and diagnostic services by a trained EJ’s Appliance Repair technician, will be communicated to you before our visit. Acceptance of the Service Order indicates your agreement to: a) Pay the Service Charge in full, regardless of subsequent repairs. b) Include the Service Charge in the total cost if you opt for recommended repairs. Sales tax, if applicable, will be included in the total quoted Price.

PAYMENT TERMS AND COLLECTION COSTS

Payment is due upon service completion unless otherwise specified in writing. Accepted forms of payment include cash, check, or credit card. A $50.00 processing fee applies to any returned check or bank draft. You agree to cover all collection expenses incurred by EJ’s Appliance Repair for unpaid amounts, inclusive of attorney’s fees, filing fees, and related costs. Past due amounts accrue interest at 18% per annum or the maximum allowed by law, whichever is less.

LIMITED WARRANTY

We warrant the repairs, parts, and services provided, assuring they are free from defects in material and workmanship, unless stated otherwise on the Invoice. This warranty is valid for ninety (90) days from the date of part receipt or service/repair. To address defects within this period, promptly notify us. Our obligation is, at our discretion, to replace any defective parts or refund amounts paid by the Customer. Warranty claims are subject to inspection and approval by EJ’s Appliance Repair.

Exclusions to the warranty: a) Commercial or industrial appliance usage. b) Cosmetic or non-functional parts. c) Plumbing supply lines. d) Appliances moved from the original repair/installation location. e) Appliances with unavailable original manufacturer parts. Payment of all outstanding amounts under the Price Quote is a prerequisite for warranty fulfillment.

These warranties are exclusive and replace all other warranties, express or implied, extending only to Customers.

LIMITATION OF DAMAGES

EJ’s Appliance Repair shall not be liable for special, incidental, indirect, or consequential damages arising from breach of warranty, breach of contract, negligence, or any other legal theory under this Agreement. Liability is limited to the amount paid by the customer. This limitation does not apply to personal injury claims.

ENTIRE AGREEMENT

These General Terms and Conditions of Service and each Service Order constitute the complete Agreement between EJ’s Appliance Repair and the Customer, superseding all prior agreements or representations, written or oral.

GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by Kentucky state laws, excluding choice of law principles. Disputes are subject to binding arbitration conducted by a Kentucky court in accordance with the Federal Arbitration Act and the Commercial Rules of the American Arbitration Association.

DAMAGE WAIVERS

Customers are responsible for understanding and accepting our waivers governing services. Services are provided under these waivers, and the customer’s acceptance is implicit when requesting our services. If one or part of these waivers is unenforceable, it does not affect the remaining waivers.

Waiver of Damages When Moving Appliance

Customers acknowledge the inherent risk of moving appliances and hold EJ’s Appliance Repair and its technicians harmless from any liability associated with potential damage.

Waiver of Damages When Working with Water

Customers recognize the inherent risk of water-related service work and agree to hold EJ’s Appliance Repair harmless, except in cases of proven negligence, from damages resulting from leaks or flooding.

Waiver of Damages from Failed Cooling Equipment

Customers understand and assume the risks associated with servicing refrigeration equipment, holding EJ’s Appliance Repair exempt from liability for failures and related consequences.

Waiver of Damages from Lifting Glass Cook Top

Customers acknowledge the risk of breakage when lifting glass/ceramic cooktops, agreeing to hold EJ’s Appliance Repair harmless from any responsibility for potential damages.
